After getting affidavits from the witnesses not interviewed by police and meeting with the prosecutor we were able to get the charges reduced to one count of child abuse, with 15 years probation, no sex offender registration.
  • Client was charged with three counts of sexual conduct with a minor. (Statutory Rape) he was facing one year in prison, life time probation and sex offender registration. ARIZONA DRUG ATTORNEYS FOR DRUG CRIMES:

It is very common for law enforcement to find a reason to stop almost any rental car they see traveling through the state of Arizona, especially on I-8 and I-40. Once they stop you, they generally give you a warning ticket and as you are walking back to your car, they ask you if they can search your vehicle. You do not have to consent the this search. If you do, they will search your car and may very well bring in a drug dog to help. If you refuse, they generally can not search your car and in most cases they can not hold you while they bring in a drug dog, unless they have evidence that a crime is or is about to be committed. This is a very common practice on all of interstate highways including i-10, I-8, I-15 and I-40. However, if they have a drug dog with them when they stop you they can run the dog around your car.

Another method they use is to use a drug dog at the immigration checkpoint on I-8 between Yuma and Gila Bend, Arizona. They also have other portable check points throughout Arizona. If you are arrested at the Wellton checkpoint on I-8 in Arizona for a small amount of drugs, you will be required to appear in the Wellton Justice Court. If you are stopped at the Welton checkpoint on I-8 and arrested for possession of drugs for sale or large amounts of drugs, you will be required to appear in Yuma County Superior Court. They also set up portable check points on the surrounding two lane highways all over the state of Arizona. If you are charged with simple possession of marijuana we are generally able to handle with case without you having to travel back to Wellton for Court. (this is up to the judge) As you pull into the check point they will sometimes, point blank, ask you if you are driving a rental car. If you are they most likely will ask you if they can search your car. They also look for signs that people are trying to cover the smell of drugs like people lighting up cigarettes spraying air freshener etc.

DRUG DEFENSE IN ASSAULT CASES

In Arizona assault is governed by A.R.S. 13-1201-1213. These statutes cover, endangerment, Threatening and intimidating, assault, aggravated assault, aggravated assault on a police officer, aggravated assault on a teacher, illegal use of a laser pointer, unlawful discharge of a firearm, prisoner assault, and all areas of assault.

AN ATTORNEY IN ENDANGERMENT CASES

If a person commits endangerment by recklessly endangering another person with a substantial risk of imminent death or physical injury. Endangerment involving a substantial risk of imminent death is a class 6 felony. In all other cases, it is a class 1 misdemeanor.

AN ATTORNEY IN THREATENING OR INTIMIDATING CASES

If a person commits threatening or intimidating if the person threatens or intimidates, by word or conduct, if they threaten to, cause physical injury to another person or serious damage to the property of another; or to cause, or in reckless disregard to causing, serious public inconvenience including, but not limited to, evacuation of a building, place of assembly or transportation facility; or to cause physical injury to another person or damage to the property of another in order to promote, further or assist in the interests of or to cause, induce or solicit another person to participate in a criminal street gang, a criminal syndicate or a racketeering enterprise.

Threatening or intimidating described above is a class 1 misdemeanor, except that it is a class 6 felony if: The offense is committed in retaliation for a victim’s either reporting unusual activity or being involved in an organization, other than a law enforcement agency, that is established for the purpose of reporting or preventing criminal activity, the person is a street gang member or threatening or intimidating induce or solicit another person to participate in a criminal street gang, a crime syndicate or a racketeering enterprise is a class 3 felony.

AGGRAVATED ASSAULT

If a person commits aggravated assault if the person commits assault under any of the following circumstances: If the person causes serious physical injury to another. If the person uses a deadly weapon or dangerous instrument. If the person commits the assault by any means of force that causes temporary but substantial disfigurement, temporary but substantial loss or impairment of any body organ or part or a fracture of any body part. If the person commits the assault while the victim is bound or otherwise physically restrained or while the victim’s capacity to resist is substantially impaired. If the person commits the assault after entering the private home of another with the intent to commit the assault. If the person is eighteen years of age or older and commits the assault on a child who is fifteen years of age or under. If the person commits assault as prescribed by section 13-1203, subsection A, paragraph 1 or 3 and the person is in violation of an order of protection issued against the person pursuant to section 13-3602 or 13-3624. If the person commits the assault knowing or having reason to know that the victim is any of the following: a teacher, a cop, a paramedic, fire fighter, or a prosecutor.
